Terms of Use

These Terms are the agreement between you and Who – Gym Partner. They cover what the App is for, how sessions and join requests work, the conduct expected of everyone, and the limits of our responsibility. Please read section 3 and section 7 in particular — they explain what this App is not, and what you take on when you train with someone.

1. Acceptance

By downloading, installing or using Who – Gym Partner ("the App"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the App.

During onboarding you are also asked to accept the Community Commitment. That commitment is a summary of section 7 below, and accepting it is a condition of using the coordination features.

2. What the App Is

Who – Gym Partner is a local fitness coordination utility. It lets you:

  • Discover fitness venues near you and see the activities available at each one
  • Read lightweight informational guides about those activities
  • Browse workout sessions attached to a specific venue, activity, date and time
  • Create your own session and review requests to join it
  • Send a request to join someone else's session
  • Coordinate privately with a training partner once a request has been accepted
  • Keep a personal training calendar and a private post-session check-in

The App is a coordination tool. We are not a party to any session, we do not organise sessions, we do not employ or vet coaches, and we do not operate any venue.

3. What the App Is Not

Who – Gym Partner is not a dating, romance or social discovery service, and it must not be used as one.

  • There is no profile swiping, no matching, no likes and no attractiveness rating — by design, not by omission.
  • There is no random chat, no anonymous chat and no random video calling.
  • You cannot message a person you are not confirmed to be training with.
  • Using the App to seek romantic or sexual contact is a breach of these Terms and results in removal.

The App is also not a medical, coaching or fitness-instruction service. Activity guides are general information about a sport, not training programmes, and nothing in the App is medical advice, diagnosis or treatment.

4. Eligibility

You must be at least 16 years old to use the App. If you are between 16 and 18, you may use it only with the knowledge and consent of a parent or guardian. You must have the legal capacity to enter into these Terms, and you must not be barred from using the App under any applicable law or by a previous removal for a guideline breach.

5. Your Profile

Your profile is a training profile. You choose a first name, an area, a short fitness introduction, the activities you train, your experience level in each, your availability and your preferences. You agree that the information you provide is accurate — in particular your experience level, because other athletes rely on it to plan a safe session.

Do not impersonate anyone, do not use someone else's photo, and do not publish another person's personal information. Do not put contact details, commercial offers or links in your profile.

6. Sessions & Join Requests

  • Creating a session means committing to a real venue, activity, date and time. Describe it honestly, including intensity, level and what participants need to bring.
  • Requesting to join requires a short introduction and a confirmation that you can attend. Requests should be about the training.
  • Organisers decide. An organiser may accept or decline any request, for any reason, without explanation. A declined request is not a judgement about you.
  • An accepted request creates a training connection and opens a private conversation for that session. Nothing else does.
  • Show up, or cancel early. Other people plan their week around your confirmation. Repeated no-shows may lead to removal.
  • Costs are yours. Venue entry fees, memberships, court bookings and equipment are between you and the venue. The App has no in-app purchases and does not process payments.

7. Community Guidelines

Everyone using the App agrees to the following. These are enforceable terms, not suggestions:

  • Respect other participants. Treat people as you would in a shared gym.
  • Keep conversations related to training and session coordination. Messaging exists to agree where to meet, what to bring and when to start.
  • Do not send unwanted messages. If someone declines a session or stops replying, do not contact them again.
  • Report inappropriate behaviour. Use the report option in any conversation or profile.
  • Follow venue and activity safety rules. Inductions, belay checks and lane etiquette exist because people get hurt without them.
  • No romantic or sexual use, no sexual content, no nudity, and no comments about anyone's body or appearance.
  • No harassment, hate speech, threats, stalking or discrimination of any kind.
  • No commercial use — no advertising, recruiting clients, selling supplements, promoting paid coaching, or spam.
  • No illegal activity, including the promotion of banned substances.
  • No minors. Do not invite anyone under 16 to a session arranged through the App.
  • No misuse of the App itself — no reverse engineering, scraping, automated access, or attempts to bypass the request-and-approval flow.

8. Messaging & Calls

Messaging becomes available only when a join request is accepted, or when you and another athlete are confirmed participants in the same session. One-to-one calls are available only inside such a conversation. There is no random chat and no random calling.

Every conversation offers report, block and leave. Blocking hides the conversation, prevents further contact and cancels pending requests in both directions. Calls are not recorded.

9. Safety & Assumption of Risk

Physical training carries risk of injury, and meeting people you do not know carries its own risks. You use the App and attend sessions at your own risk.

  • Meet at the listed training venue. Do not agree to meet somewhere else for a first session.
  • Keep first sessions in public areas of the venue, where staff and other members are present.
  • Tell someone your plan — which venue, and when you expect to finish.
  • Do not share personal contact details before you have trained together. You do not need to.
  • Know your limits. Scale the load, take the rest, and stop a session that does not feel safe.
  • Consult a professional. Talk to a doctor before starting a new activity, especially after an injury or a long break.
We do not verify users. We do not run background checks, confirm identities, or verify the experience levels people claim. Participation signals shown in the App are informational only and are not a safety guarantee. Use your own judgement, and report anyone who makes you uncomfortable.

10. Venue Information

Venue details — opening hours, facilities, ratings, activities and distances — are provided for guidance and may be incomplete or out of date. Confirm the important details with the venue directly, particularly access requirements, fees, induction rules and whether a session type is permitted. We are not affiliated with, and do not endorse, any venue listed in the App.

11. Reporting & Enforcement

Report any user from a conversation or a profile. Reports are confidential and we aim to review them within 48 hours. Depending on what we find, we may issue a warning, remove content, restrict coordination features, or remove access to the App entirely. Serious matters may be referred to the relevant venue or to law enforcement.

12. Device Permissions

The App may ask for location, camera, microphone, photo library, notification and tracking permissions. Each is optional and each is used only for the purpose described in the Privacy Policy. Denying a permission disables the related feature but does not affect the rest of the App — location in particular always has a manual area selector as an equal alternative.

13. Content You Provide

You keep ownership of what you write and upload — your introduction, session descriptions, messages and profile photo. You grant us a limited, non-exclusive, royalty-free licence to store and display that content inside the App for the purpose of operating the service. That licence ends when you delete the content or your account, except where we must retain something to handle a safety report or meet a legal obligation.

You are responsible for the content you provide and confirm you have the right to share it.

14. Intellectual Property

The App — including its software, interface, branding, icon, colour system, activity guides and design elements — is owned by Who – Gym Partner or its licensors and is protected by intellectual property law. You receive a personal, non-transferable, revocable licence to use the App on devices you own or control. No other rights are granted.

15. Availability & Changes

We may add, change or remove features, and we may suspend the App temporarily for maintenance or for reasons outside our control. We aim to give notice of material changes inside the App, but we do not guarantee uninterrupted availability.

16. Termination

You may stop using the App at any time, delete your account from Profile > Trust and Safety > Delete Account, or uninstall it. We may suspend or terminate your access if you breach these Terms, if your conduct puts other users at risk, or if we are required to do so by law. Sections 13, 14, 17, 18 and 19 survive termination.

17. Disclaimer

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted performance.

We do not warrant that you will find a training partner, that a session will take place, that another participant will attend or behave appropriately, that venue information is accurate, or that use of the App will produce any fitness outcome.

18. Limitation of Liability

To the maximum extent permitted by law, Who – Gym Partner and its affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the App.

In particular, and to the extent the law allows, we are not liable for injury, loss or damage arising from a workout session, from the conduct of another user, or from conditions at a venue. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud.

19. Governing Law

These Terms are governed by the laws of the jurisdiction in which the publisher is established, without regard to conflict-of-law rules. If you are a consumer, you keep the benefit of any mandatory protections and the right to bring proceedings in the courts of your country of residence.

20. Changes to These Terms

We may update these Terms as the App evolves or as the law changes. Material changes are reflected by the "Last updated" date and announced in the App before they take effect. Continuing to use the App after that means you accept the revised Terms.
